Borell agrees to pay Rood & Riddle in lawsuit settlement – Horse Racing News

Maria Borell and Rood & Riddle Equine Hospital have reached a settlement in the lawsuit brought by the Lexington-based veterinary clinic against Borell alleging non-payment of $15,191.14 for services rendered to horses at the Beacon Hill farm that she managed between January 10, 2013 and December 11, 2014.

Under the terms of the agreement, reached in Fayette Circuit Court on June 20, Borell agrees to pay $250 each month, beginning July 1, 2016, with any remaining balance to be paid in full by December 31. 2017.

The agreement states that the full amount will be due in seven days if Borell receives judgment in a breach of contract lawsuit it filed against James and Linda McIngvale, seeking a 10% commission for their Runhappy victory. at the 2015 Breeders’ Cup Sprint. The Super Saver colt won $820,000 for the win.

Borell, who was a private coach for the McIngvales for much of 2015, saddled Runhappy for five straight wins but was fired the day after the Breeders’ Cup. She then sued the McIngvales, asking for 10% commissions for eventual champion Eclipse Award wins, as well as lifetime breeding as soon as the horse enters stud. She also sued the McIngvales for defamation for comments they made about her after she was fired.

The agreement also states that “the parties specifically reserve whether defendant (Borell) is personally liable for this debt or whether the debt is owed by a third party, Beacon Hill Farms, LLC, with which it is affiliated. ”

Beacon Hill Farm is registered with the Kentucky Secretary of State as an LLC with Maria Borell as the manager and her father, Charles Borell, the registered agent. The Borells are part of an ongoing investigation in Mercer County, Kentucky, regarding the neglect or abandonment of animals.

Borell’s mailing address on the Circuit Court Clerk’s Certificate of Service was a farm in Clark County, Kentucky, from which she moved last December.
